'Flavor Shop' terms and conditions

 


We like to keep it simple and clear. Therefore no long complicated legal texts. Is there still something not clear to you after reading?

Do you doubt your rights or obligations? Do you have a question about your order or delivery? Do you have questions or comments about these general terms and conditions? Then send us an e-mail via our contact page. We assume that everything can be discussed and resolved in mutual consultation.

ARTICLE 2 - APPLICABILITY.


We do our best to bring these general terms and conditions to your attention. It says what we do for you and what we expect from you. Of course, that only applies if you buy or have bought something from us. Otherwise, it doesn't really apply, does it?

Some provisions of these terms and conditions only apply to consumers and not to customers who purchase products for business or professional purposes and with a VAT number. In that case, it is always clearly indicated that the relevant provision only applies to consumers.

Sometimes we offer separate terms and conditions with a product. Even then these general terms and conditions apply. If the various conditions contradict each other, you, the consumer, choose the most favourable one.

Placing an order on the website constitutes express acceptance of our general terms and conditions, which are always available on the website.

It is as simple as that.

 


ARTICLE 3 - THE OFFER.


We always tell you honestly what, when and how you can buy something, and of course what it costs. Really. Promise.

We always describe as fully and accurately as possible what we are selling you and how the ordering process will go. The description is at least detailed enough to let you make a good assessment. If we use images, they are a true representation of the goods and/or services on offer. However, to err is human and if we have made an obvious mistake, we are under no obligation to still deliver to you. And as a mistake is easily made, we cannot be held responsible for typing errors or incorrect ingredient lists, as a supplier can sometimes change its recipe at will. Always check the product packaging for the latest nutritional values and ingredients. Under no circumstances can compensation or reimbursement be claimed for this.

To purchase a product, add it to your shopping basket. Then enter your contact details and billing information. Then you choose your delivery method (more information on delivery methods can be found in article 11). In the final step, you will see an overview page, accept our general terms and conditions and confirm your payment by pressing the order button labelled "order with payment obligation". Once you have completed these steps, your purchase is final.

By placing an order for alcoholic beverages, the customer confirms that he is at least 18 years old. In case of doubt about the customer's age, we reserve the right to cancel the order.

 


ARTICLE 4 - THE AGREEMENT.

 

Your order is complete and the agreement between us is final as soon as we confirm your order by e-mail and as soon as we receive approval from the card issuer for your credit or debit card payment transaction. We offer the following payment methods and options

If your card issuer refuses to agree to your payment to us, we cannot be held responsible for delays in delivery and/or non-delivery of your order. We cannot accept or process orders without valid payment in the name of the registered cardholder.

You do business with us online in a secure web environment. This is something we and our website provider work on every day. To ensure safe online payment and the security of your personal data, we also encrypt the transaction data with SSL technology when sending it over the Internet. You do not need any special software to pay using SSL. You will recognise a secure SSL connection by the "lock" in the lower status bar of your browser.

You must be at least 18 years old to place an order. If you are not 18, we ask you to have the order placed by your parents or legal guardian. If we find that an order has been placed by a minor, we may refuse this order.

 

ARTICLE 5 - RIGHT OF WITHDRAWAL.


You have bought a product or placed an order that you are not happy with? We regret that! Fortunately, you can return non-food products within 14 days of receipt if you have ordered as a consumer. You don't even have to give a reason for this at all. So 'because' is just fine. We do our utmost to arrange the refund within 10 working days.

Please note that food products cannot be returned.

Only 1 condition applies: the products must be returned unopened, unused and undamaged to the address above.

You must be keen for everything to go smoothly. Just as well. Because we want that too! So please include a copy of the invoice with the returned products. Then we can easily find everything and take care of it.

The right of withdrawal does not apply to all purchases for business or professional purposes.

 

ARTICLE 6 - SHIPPING COSTS IN CASE OF WITHDRAWAL.


There are none: we will refund them to you.

 


ARTICLE 7 - EXCLUSION OF THE RIGHT OF WITHDRAWAL.

You probably understand that you cannot return the following items:

Products whose seal has been broken or the packaging has been opened/broken.
Redeemed or completed vouchers or gift vouchers.
Items that are damaged or incomplete.
Products that spoil quickly or have a limited best-before date.

 


ARTICLE 8 - THE PRICE.


There is no difference between the prices at our shop, on location such as fairs and markets and on our website.

All prices quoted include 6% VAT, except for products where 21% applies (e.g. alcohol).

Normal shipping is always free from an amount of 75 euros within Belgium and the Netherlands. Do not panic! This happens automatically :-) Do you order for a lower amount? Then 6.95 euro shipping costs will be added to your order in Belgium and the Netherlands. Different rates apply for shipping to other countries within Europe, please check our webshop. Do you collect your products in our shop? Then it goes without saying that you pay no shipping and preparation costs.
These rates apply to consumers. For companies, other rates apply.

 


ARTICLE 9 - CONFORMITY.


We guarantee that our goods are in conformity with your order and meet the normal expectations you may have with regard to the specifications of the product. Of course, we also guarantee that our goods comply with all laws existing at the time of your order.

Moreover, exclusively for consumers, we apply the statutory minimum guarantee period of two years for the delivery of goods if the good does not conform to the order placed. This means that if the goods are faulty or defective, they will be repaired or replaced free of charge up to two years after delivery.

Insofar as this is possible and reasonable, as a consumer you have the choice between repair or replacement. Only if the repair or replacement is excessive or impossible or cannot be carried out within a reasonable period of time, do you have the right to demand a price reduction or the cancellation of the sales agreement.

If the defect or fault manifests itself within 6 months of delivery, it is deemed to have already existed before delivery, unless we can prove otherwise. After 6 months, you will have to prove yourself that the defect already existed upon delivery.

In any case, you are entitled to a good product, full stop. If there is something wrong with it, we will solve it for you. Contact us via our contact details in article 1.

 


ARTICLE 10 - DELIVERY AND FULFILMENT.

We do our best to serve you well. We try really hard. We really do!

If you order something from us on working days, we will take your parcel to the post office for dispatch within 3 working days. Unless you come to collect the parcel from our shop or we have agreed something else with you.

If we can no longer deliver an ordered product, we will let you know as soon as possible. You then have the choice. Either you get your money back or we offer you an alternative.

We can ship your order to Belgium, Luxembourg, France and the Netherlands. We also deliver to a number of other European countries, but always subject to acceptance of the order by us. The products are sent to the shipping address you specify when ordering (home address or other address).

We never deliver outside the European Union. We cannot be held responsible for shipments outside the EU. Transport and any additional costs can never be recovered from Flavor Shop.

Our shipments are always made at our risk. So you don't have to worry about goods getting lost in the post. However, if you return goods to us within 14 days of purchase because you prefer not to keep them, you are responsible for the transport.

By accepting the package, you agree that the order has arrived in good order. If your package with the order appears damaged, you must refuse the package and have it returned.

If there is a problem with the delivery of your order, it is always best to contact our customer service via article 1 within 2 days of receiving the parcel. We always try to find a good solution to any possible problem with the delivery of your order.

The delivery times indicated on the website are always indicative and not binding. We make every effort to respect the indicated delivery time. If we are unable to deliver within 30 days, we will always inform you before this period expires. If we fail to do so, you may cancel your order free of charge. In that case, we will refund you at the latest within 30 days after cancellation.

 


ARTICLE 11 - PAYMENT.

 

If we ask you to pay an amount in advance, we will complete your order immediately upon receipt.

ARTICLE 12 - COMPLAINTS AND DISPUTES

 


Do you still have a complaint despite all our concerns? Then of course that is very annoying. We will do everything we can to resolve your complaint. Naturally, we have a procedure for that. If you have a complaint, please let us know as soon as possible via Article 1. Describe your problem as clearly as possible, so we can help you properly. We will get back to you within two working days at the latest. We will help you immediately, or we will tell you how much time we need to rectify the problem.

All agreements we conclude with our customers, regardless of their place of residence, are governed exclusively by Belgian law and, in the event of disputes, only the competent Belgian courts have jurisdiction. If, for reasons of international law, a different law does apply, the interpretation of these general terms and conditions will primarily refer to the Belgian Economic Law Code.

The application of the Vienna Sales Convention is expressly excluded.

In the event of out-of-court settlement of the dispute, the Consumer Ombudsman Service of the Federal Government is authorised to receive any application for the out-of-court settlement of consumer disputes. The latter, in turn, will either process the application itself or forward it to a qualified entity. ARTICLE 13 - YOUR PERSONAL DATA.

ARTICLE 14 - CANCELLATIONS WORKSHOPS.

 


1. It is not possible to cancel your registration for a workshop less than 7 days before the workshop. Is it really impossible to attend? Then it is possible to transfer your registration to another person. Provided this is communicated at least 2 working days before the workshop.
If you cancel more than 3 weeks in advance, we will refund the full amount. Up to 7 days in advance, we will refund 50%.


2. If there are not enough registrations for a particular workshop, Flavor Shop reserves the right to cancel a workshop. Flavor Shop must notify participants at least 2 working days before the workshop, unless the teacher falls ill at the last minute. The registration fee will be refunded in full in either case.

 


ARTICLE 15 - ADDITIONAL OR DIFFERENT PROVISIONS.

1. So, these were our terms and conditions. Clear, right? This text legally defines the rights and obligations. Both ours and yours, the user and customer of our website. Although we always do our utmost to keep all our customers happy, it is necessary to publish the terms and conditions in this form.
2. If we make any changes to these terms in the future, you will find them on our website. In any case, we make sure that changes are not detrimental to you.
